In essence, this bill, known as the “Anti-Red Flag Act,” seeks to prohibit the recognition, service, and enforcement of extreme risk protective orders in Texas. The bill prevents Texas entities, including state agencies and local municipalities, from adopting any rules or policies related to extreme risk protective orders. It also deems any federal statutes or regulations on extreme risk protective orders that infringe on constitutional rights unenforceable in Texas. Additionally, Texas entities would be prohibited from accepting federal grants for enforcing such orders. A person who enforces or attempts to enforce an unauthorized extreme risk protective order in Texas commits a state jail felony. The Act is set to take effect on September 1, 2025.
